HC seeks presence of Jigisha's murderers

The Delhi High Court on Monday directed Tihar Jail authorities here to produce before it the two death row convicts in Jigisha Ghosh Murdercase on the trial Courtreference for confirmation of capital punishment given to them.

A division bench of Justice Gita Mittal and Justice R.K. Gauba issued production warrant to convicts Ravi Kapoor and Amit Shukla for September 15.


The trial Courthas to refer each death penalty case to a high Courtfor confirmation of sentence within 30 days of the pronouncement of the verdict. On August 22, while sentencing the convicts to death, the trial Courthad referred the case to high Courtfor confirmation of sentence.

HC notice to Centre on WhatsApp users' privacy issue

The DelhiHigh Courton Tuesday issued notice to the Centre on a petition that said privacy of WhatsApp users has been threatened by a new policy announced by Facebookwhich owns the mobile messaging service.

A division bench of Chief Justice G. Rohini and Sangita Dhingra Sehgal sought the government's response by September 14 on the plea which said the new policy announced by WhatsApp, FacebookInc and FacebookIndia Online Pvt Ltd severely compromises the rights of the users.

Bombay HC permits women inside Haji Ali dargah

In a historic verdict, the Bombay High Court on Friday permitted the entry of women upto the restricted grave area of the famous Haji Ali dargah located off the Worli seashore.

A division bench of Justice V M Kanade and Justice Revati Mohite-Dhere stayed the judgement for six weeks to allow an appeal in the Supreme Court.

HC directs SSC Board to pass a girl with learning disability

Mumbai, Aug 23 Observing that students with learning disability deserve sympathy and grace from authorities in their performance, the Bombay High Court has directed the Maharashtra State Board of Secondary and Higher Secondary Education to pass a girl who was detained in SSC for her failure to obtain minimum marks in an optional subject.

Bhamisha Singh, who appeared for SSC examination in March 2016, passed in all the subjects but was detained as she failed to obtain minimum passing marks in Information and Communication Technology, having secured 17 out of 50 marks.

Manjula Chellur sworn-in as Chief Justice of Bombay High Court

Mumbai, Aug 22 Justice Manjula Chellur today took oath as the Chief Justice of the Bombay High Court, the second woman to occupy the post.

Chelluar, who was the Chief Justice of Calcutta High Court, was transferred following the retirement of D H Waghela as Chief Justice of the Bombay High Court on August 10.

Waghela held the post for six months.

HC orders CBI inquiry into Bulandshahr gangrape case

Allahabad, Aug 12In a snub to the Samajwadi Party government in Uttar Pradesh, the Allahabad High Court today ordered a CBI inquiry into the Bulandshahr gangrape case observing that it was "not satisfied" with the police investigation so far.

The high court, which had taken suo motu cognisance of the July 29 incident, also said it intended to "monitor the investigation into the case".

Tamil Nandy assembly wants high court named after state

A resolution to this effect moved by Chief Minister J. Jayalalithaa in the assembly was unanimously adopted.

Moving the resolution, Jayalalithaa said the central government on July 19 placed in the Lok Sabha the High Courts (Alteration of Names) Bill, 2016, to change the names of Bombay, Kolkata and Madras High Courts.

HC disposes of Nalini's petition for pre-mature release

Chennai, Madras High Court today declined to entertain a plea by Rajiv Gandhi assassination case convict Nalini Sriharan seeking pre-mature release, saying it cannot grant her request in view of pendency of a related matter before the Supreme Court.



Justice M Sathyanarayana made it clear that the prayer of Nalini, a life convict, seeking a direction to the Tamil Nadu government to consider her plea for premature release under Article 161 of the Constitution cannot be granted until and otherwise the litigation before apex court reached finality.

The petition filed by Rae Bareli resident Ramesh Singh contended that Sonia Gandhi was a citizen of both Italy, her place of birth, and India where she took up residence after her marriage into the Gandhi family.

HC stays rustication of JNU student

 The Delhi High Court has put on hold the rustication of a JNU student who had accused a hostel warden of sexual harassment, saying the university did not follow the prescribed procedure while taking the decision.

Sheena Bora case: Driver claims Indrani planted a gun on him

 Key accused Indrani Mukerjea's former driver Shyamvar Rai, who has turned approver in the Sheena Bora murder case, has submitted that his 43-year-old employer 'implicated' him in an arms case by planting a gun on him soon after allegedly killing her daughter.

He has made this claim in his confessional statement, which was unsealed by the special CBI court today following a Bombay High Court directive yesterday.

Rai was the first to be arrested in the case in August 2015, taking the lid off the murder, after he was picked up in connection with an arms case.

The trial court recently allowed Rai to turn approver in the case and become a prosecution witness.

"Income-based quota against spirit of Constitution"

Petitioners challenging Gujarat government's ordinance granting 10 per cent reservation to economically weaker sections (EWS) for unreserved category today told the High Court that such income-based quota is against the spirit of Constitution as it would divide the society.

In their reply submitted before a division bench of Chief Justice R Subhash Reddy and Justice V M Pancholi, the petitioners refused to accept the government's claim that ten per cent EWS quota is just a classification and not a reservation.

In the reply, the petitioners said that the ordinance would lead to classification among socially and educationally advanced classes.

Allahabad HC denies alimony to divorced working woman

A lower court order directing payment of alimony to a divorced woman under the Domestic Violence Act has been set aside by the Lucknow bench of Allahabad High Court on grounds that she was a working woman.

The high court on Wednesday ruled that a working woman is not entitled to alimony under the Act and directed the lower court to reconsider its decision.

Bank can recover loan dues from debtor's SB account: HC

If a debtor failed to settle the loan dues despite reminders from the bank, then the money could be recovered from his savings bank account, ruled the Madras High Court bench here today.

Justice M Venugopal dismissed a writ petition filed by a retired Tamil Nadu Electricity Board employee, who sought to restrain a nationalised bank from recovering the farm loan dues from his pension amount in the savings bank account.

The court observed that the bank was right in recovering the due amount from his savings bank account as per the mandate given by him at the time of availing the loan.

Remove all religious structures encroaching on roads: HC

The Allahabad High Court has directed the Uttar Pradesh government to remove or shift religious structures "in any form" which encroach on public roads including sideways.

It asked the state government to ensure that no religious structure in any form, whatsoever, shall be allowed or permitted to be raised on public roads including highways, streets, pathways and lanes and warned that any violation will be considered as criminal contempt by administration and police officials.

'Udta Punjab' row: Bombay HC adjourns hearing till tomorrow

The Bombay High Court on Wednesday posted the petition filed by Phantom Films - one of the producers of the movie 'Udta Punjab' - for further hearing on Thursday.

The High Court allowed the company to amend its petition allowing them to challenge the Censor Board's order suggesting 13 cuts in the film.

With the 'Udta Punjab' issue turning into a war between co-producer Anurag Kashyap and Central Board of Film Certification (CBFC) chairperson Pahlaj Nihalani, the producers earlier today moved the Bombay High Court seeking a copy of the order of the Censor Board Review Committee report on the film.
